Deputy Head of the Russian Ministry of Justice Andrei Loginov said that the position of the Constitutional Court actually prohibits the abolition of the moratorium on the death penalty in the Russian Federation.
Russia has a stricter legal regime of non-application of the death penalty than the international one, he noted in Geneva, presenting Russia’s report during the periodic review of the country at the UN Human Rights Council.
This legal regime, according to Loginov, is based on the position of the Constitutional Court, according to which, as a result of a long moratorium on the use of the death penalty, stable guarantees of the human right not to be subjected to such punishment have been formed. Based on this position, the representative of the legal department actually ruled out the possibility of returning to the use of the death penalty in Russia.
