The procedure for establishing parents whose germ cells were used to fertilize a surrogate mother was developed by the Ministry of Health of the Russian Federation. The draft of the relevant resolution of the Government of Russia was recently submitted for public discussion.
As it became known to MK, the establishment of a genetic relationship between the alleged biological parents and the child is proposed to be made a mandatory stage of surrogate motherhood. The procedure is planned to be done no later than one month after the birth of the child using a molecular genetic study.
At the same time, it will be possible to conduct it at the request of the parents, provided that the surrogate mother is informed about this, and she consents to the collection of biological material from the child. In other words, if the surrogate mother refuses the examination, the child will not be able to be adopted.
The biomaterial of the child will need to be taken at the institution where he was born, parents – where they will conduct an examination. The results of the study are documented in a conclusion that confirms the fact of establishing the parents as the genetic mother and the genetic father or a single woman as the genetic mother. The document is issued in three copies: the first is issued to parents, the second is kept for at least 50 years in the medical organization that conducted the examination, the third is transferred to the organization where the child was born.

– One gets the feeling that the state is heading for a gradual ban on the legal use of surrogate motherhood. The document once again confirms the right of the surrogate mother to control the fate of the child. This will make the procedure for using surrogate motherhood even more uncertain for parents who, for biological reasons, cannot have children on their own.
