The Ministry of Economy proposes to automatically extend the validity of permits in a number of areas of activity. In particular, the validity of driver’s licenses expiring in 2024–2025 can be extended for three years. Another measure is aimed at simplifying the work of companies: we are talking about maintaining a simplified regime for permitting procedures in a number of areas – a shortened list of documents to be submitted, deadlines for granting permits, as well as a list of mandatory requirements. The government explains the relaxations using a risk-based approach – they became possible where over the past two years business has complied with mandatory requirements and where they provide a noticeable economic effect.
The Ministry of Economy has developed draft amendments To resolution Government No. 353 “On the peculiarities of licensing activities in the Russian Federation”, extending the simplified regime for obtaining permits, as well as introducing automatic renewal of certain licenses and permits that are soon to expire.
Let us remind you that in order to support business under sanctions, the government in March 2022 allowed industry regulators to extend the validity of licenses and other permits for a year. This measure affected more than 120 types of permits in agriculture, industry, retail trade (including trade in excisable goods), communication services, taxi services and other areas. Later, the authorities extended some of these relaxations until 2023.
As the Ministry of Economy explains, the decision to extend some of the relaxations until 2024 was made both on the basis of proposals from industry regulators – the Ministry of Emergency Situations, the Ministry of Internal Affairs, the Ministry of Health, the Ministry of Finance and others, and on the basis of assessments of the potential economic effect of such measures.
The regulators took into account the absence of negative effects during the previous extension, explains the secretariat of Deputy Prime Minister and White House Chief of Staff Dmitry Grigorenko, who oversees the CND reform.
They note that an analysis of the effect of such extensions will be used when considering the possibility of introducing on a systematic basis the automatic renewal of all licenses and permits, provided that the business meets all regulatory requirements. Thus, we are talking about transferring low-risk permits to an indefinite regime and introducing differentiated validity periods for the rest depending on the degree of risk. Let us remind you that the White House expects the development of tools for assessing the latter from the control and supervisory authorities themselves: only evidence-based risk indicators will open up the opportunity for inspectors to conduct scheduled inspections of companies under the moratorium until 2030.
The Ministry of Economy’s project provides for another one-year extension of licenses for television and radio broadcasting (at the same time, Roskomnadzor has already prepared legislative changes to transition to the perpetuity of such licenses) and registration certificates of medicines (if they expire in 2024), as well as licenses for the retail sale of alcoholic beverages in duty free shops (expires 14 March 2025). Automatic extension is also possible for other permits, for example in the field of ecology (for the emission of pollutants).
Russian drivers can also count on automatic renewal of their licenses for three years if the current ones expire in 2024 and 2025.
Another format of relaxation is a simplified regime for permitting procedures. Relevant departments will be able to reduce the time frame for granting permits, lists of documents to be submitted and information for obtaining a permit, etc. The business will also not have to reissue permits in the event of a change in the location and implementation of the licensed type of activity, as well as in the event of renaming and reorganization. For 54 licensed types of activities, the measure to abolish the payment of state fees for the provision of services in the field of licensing is extended.
The explanatory note to the project states that, within the framework of Resolution No. 353, 15 departmental orders have already been adopted, providing for the specifics of licensing activities in the areas of circulation of pesticides and agrochemicals, use of subsoil, geodetic and cartographic activities, television and radio broadcasting. The authors of the project believe that the changes will reduce the administrative and financial burden on business. “Entrepreneurs will not need to submit documents or pay state fees. This saves both time and money for the business,” agrees Ivan Efremenkov, Deputy Executive Director of Opora Russia.
