The rules for selling apartments to orphans may change in the near future. It will become easier for guardians to obtain permission from the guardianship authorities for a transaction.
To do this, the Ministry of Economic Development is amending the law “On Mortgage”. As the developers of the bill explain, any transaction with the real estate of an orphan can only be made with the prior permission of the guardianship and guardianship authority. We are talking about both the sale of housing and its collateral for a large loan from a bank.
Under current rules, guardians or trustees must obtain such permission personally. That is, foster parents have to go to the guardianship officials with their own feet.
If the amendments are adopted, the procedure will become much easier. The guardian will be able to request permission both by e-mail and through the nearest MFC. The second option will become available if the guardianship authority concludes an agreement on cooperation with the State Services office.
Permission to a transaction or refusal can also be obtained either in the traditional paper format or in the form of an electronic document. In addition, the bank will be able to directly receive the document from the guardianship authority. To do this, the credit institution will have to connect to the system of interdepartmental electronic interaction.
