Collecting dead wood and windfall in the forest can result in a large fine and even a criminal case, said lawyer Ilya Reizer.

In a conversation with the Prime agency, he noted that harvesting dead wood is not a violation. According to him, a dead tree is considered to be a tree with signs of natural death, which lies on the ground without any traces of felling or sawing.

Moreover, if there are traces of harvesting on a tree, then it is illegal to take it.

At the same time, the lawyer noted that the collection of dead wood cannot be carried out using special equipment, but it is allowed to use hand tools. He also recommended agreeing on the issue of collecting dead wood with the tenant if the land plot is leased.

Violations in this area fall under Article 8.28 of the Code of Administrative Offenses (a fine of 4-5 thousand rubles plus confiscation of equipment), or under the Criminal Code – a fine of 100 to 500 thousand rubles (depending on the amount of damage) and imprisonment for up to seven years, the lawyer said.
