Lawyer Alexander Budaragin told in a conversation with URA.RU that both parents can go on maternity leave if they have two children under 3 years old.
“Both parents have the right to be on parental leave and receive benefits at the same time,” he said.
Budaragin explained that the legislation does not contain provisions prohibiting this. But at the same time, “there should be several children in the family who require simultaneous care for them.”
According to the lawyer, along with the mother, leave can be issued not to the father, but to another relative who actually cares for the child.
