Recently, garbage in the entrances or on the floors, left by lazy neighbors who did not reach the garbage chute, has become a real disaster in different areas of the capital. In whatever ways the residents try to fight this evil! The most common are homemade posters in the entrances: with calls for sanity and conscience, and with threats, and with analogies from fashion TV series. But there are more effective methods of bringing violators to justice, albeit more labor-intensive. A lawyer told MK about this.

In the capital’s public pages, posts about residents who are pigging in their own hallways have recently begun to appear especially often. Lack of culture and sloppiness are becoming a fad. In one of the entrances of a house in Golyanovo (VAO), residents even tried to resort to the authority of Hollywood star Jason Statham – they hung a poster with his photo and the text: “Real boys take garbage to the trash heap, and leave chushpans in the entrance to the garbage chute!” In another district of Moscow, on Millionnaya Street, one of the residents, apparently driven to the extreme, hung up a fierce notice: “If you don’t correct yourself, I’ll catch you and put a bag of garbage on your head!”

The other day, a video from a surveillance camera in the Welton Park residential complex (Marshal Zhukov Ave.) went viral on social networks: one of the residents gets out of the elevator on someone else’s floor, leaves a bag of waste and leaves. And, judging by the reviews of Muscovites, he is not alone in his boorish behavior. “We have the same “genius” from the neighboring entrance every time he leaves bags of garbage next to the entrance,” complains one resident. “Wet stuff periodically pours out of the bag, and in the summer the asphalt at this entrance smells terrible.” But we have a garbage chute in our house, and even larger garbage cans 10 meters away!” “They also live in our entrance, but we don’t need to look for a garbage dump, there is a garbage chute, but no, the “pigs” are afraid to approach it!”

MK contacted one of the Muscovites, who described her situation:

“I live in the Vykhino district, Fergana street, 15-1, and we also have pigs living in the fourth entrance,” she told us. “Not only do they throw garbage, but also all sorts of old things, sometimes even furniture.” And we’ve never even heard of taking the trash to the trash heap after renovation! They just throw it in the elevator. That year I wrote an ad and hung it in the entrance, and it seemed to me that the situation had become a little better. In it I wrote that “you are pigs, and you live not in the entrance, but in the barn,” etc. This year the ad doesn’t even hang for five minutes, they tear it down. Once I saw who was doing this: a young child with his mother. I made a remark, and in response I heard a lot of good things addressed to me. I have also seen more than once how a guy from a seemingly cultured family throws scraps on mailboxes. There are cameras in the entrance, you can use them to identify such people, but no one needs this. I take photos and post them on the city portal “Our City” so that at least the garbage is removed, otherwise until you complain, the cleaning lady will not come and clean it up….

In one of the stories that is circulating on the Internet (it is unknown whether real or fictitious), a man described how he tried in various ways to wean a neighboring family from the tradition of leaving bags of waste in the common corridor. At first he decided to take out their garbage himself, but this did not help, and then he came up with an insidious plan: he waited until winter and began carrying their bags to his balcony every day, and when there was a whole mountain of them, one night he moved the entire mountain back to these neighbors under door. Unfortunately, the author did not write about their reaction and whether this method had the desired effect. One of the Muscovites suggested teaching the dirty people this lesson: “We need to start putting our own garbage under their doors, and ask other neighbors too!”

“MK” decided to find out from lawyers how to hold violators accountable.

“If all methods of peaceful settlement have not brought any results, it is worth resorting to the help of government agencies,” says lawyer Olga Abrikosova. — I advise you to draw up such a text of the appeal (complaint) and send it to the competent authorities. You must provide as much information as you have. It will be good if you indicate the names and addresses of all violators. Describe in detail how often these residents leave garbage in the hallway. In addition, it is necessary to prepare photo and video materials that show which residents leave garbage, as well as photographs and videos of the dirtiness of the entrance. The reaction of the authorities largely depends on how complete and reasoned your appeal is. A good option would be if the application is signed by several residents of the house at once.

– To Rospotrebnadzor (the most convenient way to do this is through the official website, but you can also send it by mail or in person). It is this organization that is engaged in sanitary and epidemiological control of residential buildings. Send the second application to the local police officer. Precinct officers, as a rule, are very busy, such an offense may not interest them, but do not be afraid to be persistent, your rights need to be protected! And living in cleanliness is a natural human need that needs to be fought for. And the third addressee management company that maintains the house. She should also send an appeal, since if Rospotrebnadzor reveals violations, they have the right to file a lawsuit against the Criminal Code (also under Article 6.4 of the Administrative Code), since maintaining common property in proper condition falls within their competence. Accordingly, in the fight against garbage in the entrance, the Criminal Code can become your ally. In judicial practice, there are many cases of bringing the Criminal Code to justice for such offenses, since quite often, when the entrance is kept in a dirty state, rodents appear in the house.
