There are a number of legal grounds for checking an apartment even without the consent of the owner, and resistance can result in administrative liability, said Yegor Redin, managing partner of the law firm Position of Rights.
In a comment to the Prime agency, he noted that some structures are endowed with such a right.
One of the grounds is that law enforcement officers have a search warrant. In the event that the police are not allowed into the apartment, if there is a resolution, the owner is threatened by Article 19.3 of the Code of Administrative Offenses of the Russian Federation, which provides for liability for disobedience to a legal requirement.
In other cases, refusal to grant access to the territory of the premises is possible. This applies to the arrival of employees of the State Housing Inspection and utilities. Moreover, if, for example, a break in a water pipe occurs after these persons are not allowed into the premises, the owner will bear civil liability.
Redin also noted the right to check the premises of the employees of the Federal Tax Service, but only if the owner conducts entrepreneurial activities at home.
