The law on silence: where and at what time it is forbidden to make noise

A revised draft law on silence is being introduced to the State Duma, which establishes a noise ban for all regions. What standards are in force now and what is proposed to be changed is in the Kommersant information.

What time is considered night?

There is no law on silence at the federal level yet. All regulations establishing what time is considered night time are adopted at the level of constituent entities of the Russian Federation. For example, in Moscow night time is considered to be the period from 23 to 7 am. In St. Petersburg Quiet time is from 22:00 to 8:00.

In the Moscow region periods of rest are also described in detail. The quiet time depends on the day of the week. It is not allowed to disturb the peace and quiet of citizens from 21:00 to 8:00 from Monday to Friday. And on weekends and non-working holidays – from 22 to 10 o’clock. The use of sound-amplifying equipment, including those installed on vehicles, and repair work are prohibited from 13 to 15 hours daily.

In Kazan Quiet time is from 22:00 to 6:00 on weekdays and from 22:00 to 9:00 on weekends and non-working holidays.

What is prohibited to do at night

At night, you cannot listen to music loudly, including in the courtyard of your house, or sing or play musical instruments. This also includes another violation of the peace of citizens.

Actions that violate silence also include shouting, the use of pyrotechnics, and other loud sounds. The legislation of the constituent entities of the Russian Federation may establish other actions that are considered to violate silence.

It is prohibited to make noise not only in apartments, but also in entrances, courtyards, near kindergartens, hospitals, on the territory of sanatoriums, hotels and hostels. The quiet law is also violated by car alarms or loud music in the car, driving with a sports muffler, fireworks and noisy construction work.

What liability is provided for violations?

Failure to remain silent is a violation of sanitary and epidemiological requirements. It is subject to liability established by Articles 6.3 and 6.4 of the Code of Administrative Offenses of the Russian Federation.

Article 6.3 of the Code of Administrative Offenses is a violation of legislation in the field of ensuring the sanitary and epidemiological well-being of the population. The fine for individuals under it is 100 to 500 rubles.

Article 6.4 of the Administrative Code – violation of sanitary and epidemiological requirements for the operation of residential premises and public premises, buildings, structures and transport. The fine for individuals ranges from 500 to 1 thousand rubles.

What’s on offer now

The new project, which is being submitted to the State Duma, provides for a uniform time of silence throughout Russia – from 23:00 to 7:00 hours. Noisy work will be permitted exclusively on weekdays from 9:00 to 19:00 with mandatory break from 13:00 to 15:00.

The bill provides for a mechanism of sanctions against violators. Thus, if the law is adopted, residents will have the right to elect a person in charge at meetings who will be able to draw up acts of violation of the law and submit them to law enforcement agencies.

Fines for a primary violation, developed in the bill, start from 500 rubles for citizens, from 5 thousand for officials and from 20 thousand rubles for legal entities.
