The Krasnoyarsk prosecutor’s office proposed introducing liability for threats to kill

Krasnoyarsk regional prosecutor’s office prepared draft federal law amending the Administrative Code. It is proposed to supplement the sixth chapter of the code with Art. 6.1.2, which introduces administrative penalties for verbal threats to kill.
New Art. 6.1.2. will introduce punishment for “threats of murder or infliction of grievous bodily harm, causing moral suffering to the victim, if these actions do not contain a criminal offense.” The minimum punishment is proposed in the form of a warning, then an administrative fine in the amount of 1–3 thousand rubles. If such a threat is contained in a public speech or posted on the Internet, then the fine increases to 3-5 thousand rubles. or administrative arrest for up to five days. If the person making the threat uses his official or official position – up to 5-10 thousand rubles. and 5–10 days.
“Currently, the legislation only provides for criminal liability for threats to kill, in which the victim has real grounds to fear that this threat will be carried out. Threats, for example, made behind a closed door or during a telephone conversation, remain outside the legal framework and criminal prosecution. This can be used by collectors and other persons who threaten violence through instant messengers and the Internet,” the prosecutor’s office of the Krasnoyarsk Territory explained the need to adjust the Code of Administrative Offences.
Currently, the punishment for threats to kill is established only by Art. 119 of the Criminal Code of the Russian Federation (maximum punishment – up to five years in prison).
The bill has already been discussed at a meeting of the Committee on the Budget, State Property and Protection of the Rights of Citizens of the Krasnoyarsk Legislative Assembly. Following the discussion, the document was sent to the Council of Legislators of the Russian Federation. According to the portal of the legislative support system, the commission responsible for considering the bill (it is indicated that it is being introduced by the Legislative Assembly of the Krasnoyarsk Territory) must submit a conclusion by February 2, 2024.
