The Investigative Committee indicted the prosecutor and the judge of the International Criminal Court in absentia

The Russian Investigative Committee (ICR) has indicted in absentia prosecutor and International Criminal Court (ICC) judge Khan Karim Asad Ahmad and Rosario Salvatore Aitala in connection with the issuance of an arrest warrant for the President of the Russian Federation and the Presidential Commissioner for Children’s Rights. As specified in the ICR, on February 22, the prosecutor sent a petition to obtain a warrant for the arrest of President Vladimir Putin and authorized Maria Lvova-Belova, after which the judges of the ICC issued illegal decisions on their arrest.
The criminal prosecution is obviously illegal, since, as emphasized in the department, there are no grounds for criminal liability. The heads of state enjoy absolute immunity from the jurisdiction of foreign states, recalled in the TFR.
The investigation accused the prosecutor of the court in The Hague under several articles of the Criminal Code at once: Part 2 of Art. 299, part 1 of Art. 30, part 2, art. 360 of the Criminal Code of the Russian Federation (bringing a knowingly innocent person to criminal responsibility, combined with the unlawful accusation of a person of a particularly serious crime, as well as preparation for an attack on a representative of a foreign state enjoying international protection, in order to complicate international relations).
The ICC judge is accused of knowingly unlawful detention and preparation for an attack on a representative of a foreign state. Both are wanted.
On March 17, the Criminal Court in The Hague issued an arrest warrant for Russian President Vladimir Putin and Children’s Ombudsman Maria Lvova-Belova. On March 20, the ICR opened a criminal case against ICC Prosecutor Karim Ahmad Khan, as well as against ICC judges Tomoko Akane, Rosario Salvatore Aytala and Sergio Gerardo Ugalde Godinez.
On May 11, the Investigative Committee of the Russian Federation announced preparing put on the wanted list of ICC judges, and already on May 19, the Ministry of Internal Affairs of Russia put the prosecutor on the wanted list. Press Secretary of the President of the Russian Federation Dmitry Peskov said that the decisions of the International Criminal Court have no legal force and are void.
On March 25, State Duma Speaker Vyacheslav Volodin called for a legislative ban on the work of the ICC in Russia and the introduction of responsibility for its support. Andrei Klishas, head of the Federation Council Committee on Constitutional Legislation and State Building, said in response that the legislative reaction of the Russian authorities to the activities of the ICC would be unnecessary, since it is a “fictitious institution” and its decisions are void.
