According to prosecutors, the lady misled the jurors
The perpetrator who systematically beat the child will again appear in court, this time also on charges of his murder. In December 2021, a Moscow city court sentenced a native of Central Asia to 4.5 years in prison for inflicting “physical and mental suffering through systematic beatings and other violent acts” on his two-year-old niece. But he was acquitted on charges of intentional bodily harm and murder of a girl. In June of this year, the First Court of Appeal of General Jurisdiction upheld the verdict.
As MK previously reported, the crime was committed in the east of the capital in a two-room apartment where a 30-year-old mother of nine children aged from three months to nine years, Inna (names have been changed), and her 32-year-old sister Olga with her husband, 55-year-old Daler, a native of Central Asia. A terrible tragedy occurred on the evening of December 22, 2019, when the women went to the store, leaving Daler with their children. After some time, he called Olga and asked to return urgently. When the women came home, there were already ambulance doctors and policemen. The girl, two-year-old Sofia, was dead. According to Daler, Sophia fell from the second bunk of the bed and hit her head on a dumbbell. The man, according to him, was at that time in another room, having heard a scream, he rushed to help, took the child to the bath to wash off the blood. Then he left for a couple of minutes, and when he returned, the girl was unconscious, he tried to give her first aid. Despite the fact that much pointed to Daler’s guilt in the death of the child, he was acquitted.
The Prosecutor General’s Office of Russia raised the question of reversing the decision of the courts and sending the case for a new trial before the Supreme Court. The prosecutor’s office explained the position of the department by the fact that the defendant’s lawyer misled the jurors, distorted the facts, and made unfounded statements. So, at the beginning of her speech, the defense lawyer said that many examinations were carried out, which completely refuted the position of the prosecution. It wasn’t true. She also stated that numerous injuries in the girl were revealed on the 16th month of the investigation – this also did not correspond to reality.
On the basis of forensic medical examinations, it was concluded that the child’s death was due to “mechanical asphyxia, which developed as a result of compression of the neck organs with a noose.” However, the defender said that, in her opinion, “the noose was invented by experts.” At the end of her speech, she said that the defendant considers the ambulance doctors guilty of the death, which caused the jury to doubt the testimony of the ambulance doctors. The defendant, in turn, lied that the investigation put pressure on his wife not to testify, and also complained about the length of his stay in custody in order to pity the jury. According to the Supreme Court, these and other violations committed distort the very essence of justice and the meaning of a court decision as an act of justice. Recently, the Supreme Court overturned the decisions of both courts and ordered the Moscow City Court to reconsider the case with a different composition.
