The White House extended the mechanism of pre-trial appeal to the sphere of licensed activities – the service of complaints about the decisions of departments began to work on the public services portal, Kommersant was told in the office of Deputy Prime Minister Dmitry Grigorenko. The appeal mechanism will become available for all required types of permits by October and will allow collecting feedback from businesses to continue the reform of permitting activities. In the process of its digitization, it turned out that not all entrepreneurs are ready to receive documents in electronic form.

The reform of licensing activities received a feedback mechanism – the possibility of pre-trial appeal by business of decisions of licensing authorities. In the office of Deputy Prime Minister Dmitry Grigorenko, Kommersant was told that until October 1, 2023, the mechanism will apply to all types of documents in demand. “Pre-trial appeal is a tool that is equally beneficial for business and the state. Entrepreneurs get a simple and transparent way to protect their interests, and we get feedback. To create a truly comfortable business climate, we need to understand what the business itself wants, under what conditions it is convenient for it to work,” he notes.

Since 2021, the government has been optimizing the procedure for issuing licenses and converting it into electronic form – 340 types of permits are available on the public services portal, including 49 licenses. Now businesses do not need to provide supporting documents, the number of documents for obtaining a license has been halved (from ten to five documents), and the period for obtaining a service has been tripled (from 45 to 15 business days). The office of Dmitry Grigorenko adds that this has reduced the period of “idle” work of start-up entrepreneurs, they can immediately get involved in business processes. But during the reform process, it turned out that due to the different levels of digitalization of departments, the process of obtaining a license was not always transparent, so first it was necessary to “digitize” departments and then introduce a universal form for obtaining a license on the public services portal. But for a number of “digitized” permits, up to 70% of applications are made in paper form – the White House first wanted to understand what this was connected with. So, there are a number of permits that cannot be displayed on the public services portal due to the presence of trade secrets in the submitted documents.

Feedback from business through the “dosudebki” channel will speed up the process of setting up licensing activities. Denials of applications for obtaining and amending permits are now accompanied by an indication of mandatory requirements, where applicable. “We get statistics on the most violated requirements and we can take a closer look at them,” Dmitry Grigorenko’s office says.

Marina Bludyan, First Vice-President of Opora Rossii, believes that the resource for pre-trial appeal in licensing activities will be in demand no less than in control and supervision. “Over the past period of the CND resource, entrepreneurs went to court 16% less. Appeals considered 9 thousand, of which almost 70% in favor of the business. It is also an opportunity for the government to receive information online “from the ground”, to observe and regulate the progress of the reform,” she adds. Denis Domashnev, executive secretary of the Delovoy Rossiya expert center on CND, notes the importance of pre-trial appeal in licensing activities. “However, an appeal to the direct management of the official whose actions are being appealed is far from always effective. In state bodies with powers in the field of licensing activities, special divisions for pre-trial appeal should be created, ”he suggests.
