The explanatory note to the bill stated that persons admitted to Russian citizenship undertake to comply with the Constitution, including the article on the defense of the fatherland. The government commission indicated that evasion of military duty is already grounds for termination of acquired citizenship, since it can be considered a violation of Art. 328 of the Criminal Code of the Russian Federation (“Evasion from military and alternative civil service”).
To terminate citizenship, the review notes, a crime must be proven that undermines “the stable legal connection of the specified person with the state.” In this regard, deprivation of citizenship for failure to fulfill military registration obligations “appears to be unfounded,” and the bill itself is “excessive.”
On December 15, the court in Chelyabinsk for the first time in Russia deprived citizenship of two persons who arrived from neighboring countries for evasion due to failure to appear for military registration. Since October, it has been operating in Russia law on deprivation of acquired citizenship for sabotage, desertion, discrediting the RF Armed Forces, calls for war and other violations.
