The Meshchansky Court of Moscow on Thursday passed a guilty verdict on the founders of the Summa financial group, Ziyavudin and Magomed Magomedov. They and their accomplices were charged with organizing a criminal community, fraud, and Ziyavudin Magomedov was also charged with illegal possession of weapons. Ziyavudin Magomedov was sentenced to 19 years in prison (the prosecutor asked for 24 years), Magomed Magomedov to 18 years (the prosecutor asked for 21). During the announcement of the operative part, they smiled and talked.

The reading of the verdict lasted a week, several judges were involved in this procedure. Twice meetings were canceled and postponed due to a bomb signal.

As MK previously reported, the financiers were accused of stealing large sums during the implementation of various government contracts. In particular, they talked about embezzlement committed by the heads of companies that were part of the Summa holding. According to investigators, 5.4 billion rubles were stolen during the construction of the Kyzyl-Kuragino railway line, 752.9 million rubles – in preparation for the construction of the Kaliningrad stadium and 2.1 billion rubles – during the reconnaissance of the area for the construction of the Gazprom Arena in St. Petersburg. Both sites were strategic: they were being prepared for the 2018 FIFA World Cup. The stolen 874.6 million rubles were allocated for the supply of equipment to electrical substations under construction, 1.2 million rubles were stolen during the reconstruction of the Khrabrovo airport in the Kaliningrad region. In addition, the defendants were accused of involvement in the conclusion of “imaginary” deals between the United Grain Company and a certain company Newbay Investments LP in the amount of 613.7 million rubles.

In addition to the Magomedov brothers, heads of firms controlled by Summa were accused of crimes. These are Artur Maksidov, head of the Inteks company, Sergey Polyakov, head of the United Grain Company, Roman Gribanov, head of the department of the same company, and Yury Petrov, general director of Energia-M. They were asked to be sentenced from 8 to 18 years in prison.

Magomedov’s defense insisted that there was no corpus delicti in the case. In particular, the lawyers mentioned that the accusation of creating a criminal community provides that various structures were opened specifically for the organization of the organized criminal group. At the same time, the firms through which the fabulous sums were stolen worked long before the events described. In addition, the transactions were secured by bank guarantees and the alleged damages were repaid.

Interestingly, in parallel with the process in the Meshchansky Court, there were hearings in the Central District Court of Kaliningrad. There, an episode with the theft of 752.9 million rubles, allocated for the engineering preparation of the site for the construction of the stadium, was separated into a separate production. According to investigators, the money was stolen thanks to the sand scam – it was used less, and the saved amount was appropriated. This process has not yet been completed, as the court rejected the results of the official examination of the lack of sand. Nevertheless, the episode with the theft remained in the Moscow case.

By the way, many called the Kaliningrad scandal the main reason for the persecution of the Magomedov brothers (they were detained in March 2018). Prior to this, the oligarchs were considered inviolable figures. Both graduated from Moscow State University, founded the Diamant bank, then – in 2012 – the Summa group, enlisted the support of the state. Ziyavudin Magomedov became the main owner of the holding: it was rumored that this was largely due to his friendship with the then Deputy Prime Minister Arkady Dvorkovich (they studied together and neighbored in a hostel). Magomed Magomedov was also involved in political activities – at one time he was a member of the Federation Council from the Smolensk region. Ziyavudin got so rich that he took 63rd place in the ranking of the richest people in Russia according to Forbes.

However, at the end of 2017, they started talking about the conflict between Magomedov and the governor of the Kaliningrad region Anton Alikhanov. It was then that it became known about the waste of money allocated for the construction of the stadium. And since the construction of the facility for the 2018 World Cup was an extremely important task for the head of the region, he did not tolerate such an attitude. Shortly thereafter, both the Magomedovs and their accomplices were arrested. Other versions were also called – from purely commercial (a conflict over the sale of shares in the Novorossiysk port) to political ones (serious disagreements with the oligarch Suleiman Kerimov – there were rumors that the Magomedovs were somehow involved in the story of the detention of a businessman by the French police on suspicion of tax crimes).

Interestingly, even behind bars, Ziyavudin and Magomed did not reduce their business activity. Already in the SIZO, they sold off some of their assets – apparently in the hope of paying off the losses and thereby alleviating their lot. But this did not affect the verdict.

During the announcement, the judges emphasized that many members of the criminal organization did not know each other. However, the court did not see any grounds for releasing the defendants from criminal liability for creating a criminal community.

The court considered that all the accused, except Yuri Petrov, were “worthy” of serving their sentences in a strict regime colony. The director of Energia-M received a general regime. It was also decided to deprive Ziyavudin Magomedov of state awards (at one time he received the Order of Friendship and the Order of Honor), and each of the defendants was additionally assigned a restriction of freedom. The court also satisfied the claims against the defendants in the case for a total amount of 3.6 billion rubles.
