The Federal Tax Service has strengthened control over debtors with arrears of over 50 million rubles – Kommersant

Since January, the Federal Tax Service (FTS) has strengthened control over debtors with arrears of more than 50 million rubles. The press service of the department stated “Izvestia”that these measures are needed to assess the causes of debt and the need to provide state support to debtors.

From the letter of the Federal Tax Service it follows that individuals and legal entities, individual entrepreneurs, foreign and budget organizations are subject to enhanced control. It is expected that the list for inspection by the Federal Tax Service will be compiled monthly. At the same time, debtors undergoing bankruptcy proceedings will not be reflected in the list.

Taxpayers may be excluded from the list if they have fully or partially repaid the debt, the letter from the Federal Tax Service notes. Other grounds for exclusion are the provision of a deferment (installment plan) or migration of the debtor.

Commenting on the tightening of control by the Federal Tax Service to Izvestia, lawyer Igor Apostol suggested that such measures could be a signal to payers that their debt is known at the federal level. Finam’s strategy director Yaroslav Kabakov believes that increased control may indicate the state’s desire to maximize tax revenues and minimize the budget deficit.

Responsibility for non-payment of taxes is determined by Art. 122 of the Tax Code of the Russian Federation and Art. 198 of the Criminal Code of the Russian Federation. They can be attracted to it from the age of 16. Individual entrepreneurs are liable as individuals. The punishment is determined by the court. Liability for non-payment of taxes is calculated based on the amount of arrears. If the non-payment was unintentional, then the fine will be 20% of the debt, if intentional, then 40%.
