The Duma Committee did not support the abolition of fines for living outside the registration

State Duma Committee on State Construction and Legislation recommended reject the proposed bill abolishing administrative liability for citizens living without registration. Bill contributed in May, deputies of the “New People” faction.

The committee’s conclusion states that the bill’s “concept and content” “cannot be considered justified and do not deserve support.”

The committee’s conclusion states that the purpose of registering a citizen is not only to provide “the necessary conditions for this citizen to exercise his rights and freedoms, but also to fulfill his duties to other citizens, society and the state.”

According to the authors of the conclusion, the revision of any norms of the Code of Administrative Offenses “should be based on the analysis and assessment of relevant statistical data at the all-Russian level.” However, this data is not included in the explanatory note to the project.

At the same time, in the explanatory note, the authors of the bill, citing sociological survey data, noted that 20% of Russians do not have their own housing and rent a room or apartment. In 2017, about 25% of citizens under the age of 30 lived outside their place of registration (permanent or temporary).

Now, according to Art. 19.15.1. and 19.15.2 of the Administrative Code, fines are provided for living at the place of stay or at the place of residence in a residential building without registration or for violating the rules of registration at the place of stay or place of residence.

Those living outside the place of registration face a fine of 2–3 thousand rubles, tenants or owners (individuals) – from 2 thousand to 5 thousand rubles, legal entities – from 250 thousand to 750 thousand rubles. In federal cities, fines are higher: 3–5 thousand for individuals, 5–7 thousand for homeowners and 300–800 thousand for legal entities.

Experts note that cases of prosecution for such offenses are rare, and registration at the place of residence is necessary for sending mail and subpoenas.
