State Duma deputies approved in the first reading bill on non-discriminatory access of Internet providers to multi-apartment residential buildings. Amendments are being made to the law “On Communications”.
Now a broadband access operator (BBA), if he wants to install his equipment in an apartment building, needs the approval of 2/3 of the apartment owners at the general meeting and an agreement on payment for the use of common property.
If the law is passed, then the access of operators to apartment buildings will be carried out upon an application for connection from one of their residents and free of charge, operators will pay only for the electricity consumed by their equipment.
The bill also proposes to introduce a unified procedure for placing communication networks in homes and interaction between the telecom operator and the management company of the house. The Russian government will have to determine this order. The document also provides for the introduction of a moratorium on increasing payments under existing infrastructure placement agreements until December 31, 2024.
The bill was introduced in November last year by deputies Alexander Khinshtein and Sergei Pakhomov, as well as senators Andrei Turchak and Andrei Klishas. As noted in the explanatory note to the document, it is practically impossible to ensure the presence at the meeting of homeowners in the amount necessary to decide on the admission of the provider. “As a result, this leads to massive abuse by persons authorized to manage the housing stock, who use non-transparent schemes for coordinating the placement of equipment, effectively monopolizing the right of access of telecom operators to MKD,” the note says.
