The State Duma adopted in the first reading billwhich introduces legal guarantees and grounds for exemption from criminal liability of persons who have entered into a contract for military service during the period of mobilization, martial law or wartime.
On June 13, MPs Pavel Krasheninnikov and Irina Pankina and Senator Andrey Klishas introduced the bill “on the peculiarities of criminal responsibility of persons who are involved in a special military operation.”
The bill is proposed to be extended to three categories of people: those who have committed crimes of small and medium gravity, those who are doing military service during the period of mobilization and have committed a crime, and convicts. These situations must occur before the entry into force of the law. “This is necessary so that there are no so-called feigned crimes: when people commit crimes, so that later they can avoid punishment by concluding a contract for military service,” Krasheninnikov told Vedomosti.
All these three categories, if they are doing military service for mobilization or have entered into a contract for military service, are exempted from criminal liability from the day they are awarded a state award, which was received during military service, or from the day they are dismissed from military service.
Control over the behavior of persons affected by the amendments is carried out by the command of military units. If the convicts commit a new crime, the court imposes a punishment on them under Art. 70 of the Criminal Code, i.e. the imposition of punishment on the basis of a combination of sentences.
The bill was a continuation of an initiative that allows people with a criminal record to enter into a contract for military service during the period of mobilization, during martial law and in wartime. This project was also approved today in the first reading.
