The courts will be able to establish the moment from which they will be allowed to consider contracts between the parties in civil proceedings as modified or terminated. Amendments to paragraph 3 of Art. 453 of the Civil Code of the Russian Federation (consequences of changing and terminating the contract) was proposed by the Ministry of Justice. Now, according to the Civil Code, the parties have the opportunity not to go to court, but to conclude an agreement on changing or terminating the terms of the contract themselves.
If the parties decide to go to court, then under the current legislation, contracts are considered modified or terminated only after the entry into force of the relevant court decision. The amendments of the Ministry of Justice offer the possibility to change or terminate the contract at any time, which will be determined by the court. That is, both in hindsight and in the future.
