A court in Yekaterinburg rejected the lawsuit of the Anacondaz group about the illegality of canceling concerts in July 2022. Police said the organizers of the event failed to ensure his safety. At the same time, representatives of the prosecutor’s office said that the musicians had previously supported opposition leader Alexei Navalny and spoke out against the entry of Russian troops into Ukraine, so the cancellation of the concerts was necessary in order to prevent “provocative statements” from them. The musicians intend to appeal against the decision of the court.
The Anacondaz concert was supposed to take place on July 22 at the Yekaterinburg Tele-Club as part of the Pauzern Picnic festival. As early as July 7, the organizer of the concert, Gleb Yuryev, filed a notice with the head of the Yekaterinburg Department of the Ministry of Internal Affairs, and on July 11 – with the city administration. He received refusals to coordinate the event. Then the concert was moved to the Cuba beach complex, but on the day of the performance, police officers arrived at the site. They said that the concert should not take place.
Anacondaz musicians Artem Khorev and Sergey Karamushkin turned to the Leninsky District Court of Yekaterinburg with a lawsuit. They said that the mayor’s office and the police violated their constitutional rights to freedom of creativity and assembly, and the police, who did not allow the audience to the concert, “went beyond their powers.” “When we were approaching the complex, we were stopped by the police, who were very numerous, with the question of whether we were going to the concert or not. Those who came to the concert were turned around by law enforcement officers. Those who came to Cuba just to relax were let in,” confirmed witness Anna Rudneva. The artists demanded that the actions of officials and the police be recognized as illegal.
The representative of the Ministry of Internal Affairs stated that the organizers applied for holding a concert at the Tele-Club in violation of the deadline – later than 15 days before the event. In addition, they allegedly did not agree with the Ministry of Internal Affairs on the specifics of protecting public order. The Cuba complex also did not provide anything, so law enforcement officers arrived at the scene.
According to a police spokesman, they did not interfere with the rest of citizens, but only informed them that the event was not coordinated and unsafe.
At the meeting on November 10, the position of the prosecutor’s office of the Sverdlovsk region was presented. The agency reported that the musicians of the Anacondaz group supported the opposition leader Alexei Navalny, criticized the activities of the government and condemned the conduct of a special military operation of the Russian Federation on the territory of Ukraine. Because of this, according to the document, the prosecutor’s office suggested that the police take measures “aimed at preventing provocative political statements during the concert.”
“We believe that the ban on the event was caused precisely by the position of the group regarding the issues of conducting a special military operation. This decision is political. There were no problems with ensuring the safety of citizens at the sites, which is also confirmed by the words of the witness that citizens were calmly launched into Cuba. This means that there were no legal grounds for a ban on concert activity, ”said the group’s lawyer Alexei Bushmakov.
According to him, “the position of the administrative defendants was distorted by them.”
“Both the Ministry of Internal Affairs and the mayor’s office referred to the fact that they allegedly observed public order, although in fact they did not let people in and disrupted the concert. The court believed them. Let’s see how this decision will be motivated,” said Mr. Bushmakov.
He added that the musicians intend to appeal against the decision of the court.
