The court decided to reinstate the ex-speaker of the parliament of Dagestan as the director of the insurance fund

The Sovetsky District Court of Makhachkala ruled to reinstate ex-speaker of the People’s Assembly of Dagestan Magomed Suleymanov as director of the Territorial Compulsory Medical Insurance Fund. The director of the TFOMS, who was removed from office in 2018, must also be paid a salary for the period of suspension.
As Kommersant reported, in March, the appeal instance of the Supreme Court (SC) of Dagestan, after a second consideration, upheld the acquittal of Mr. Suleymanov, handed down in July last year and canceled in October after a complaint from the prosecutor’s office. He was accused of exceeding official powers (paragraph “c” of part 3 of article 286 of the Criminal Code of the Russian Federation) and abusing them (part 1 of article 285 of the Criminal Code of the Russian Federation).
The investigation charged him with two criminal episodes relating to the period when he was acting mayor of Makhachkala. And earlier, while holding the position of director of the TFOMS, investigators claimed, he forced the heads of private medical institutions to open current accounts in MVS-bank, the founders of which were persons affiliated with him. However, the Sovetsky District Court of Makhachkala did not find corpus delicti in the actions of the accused, and Mr. Suleimanov decided to use the right to rehabilitation.
According to the press service of the district court, the prosecutor and a representative of the TFOMS asked that the applicant be denied reinstatement, and the issue of unpaid wages was left to the discretion of the court. Government representatives also asked the court to refuse to satisfy the petition, arguing that the director of the TFOMS was relieved of his post for failing to provide income information to the personnel department, and not in connection with his criminal prosecution. However, evidence to support this argument, the court pointed out, was not presented.
The court placed the duty of admitting the applicant to the performance of official duties on the government of Dagestan, which at the end of October 2018 suspended Magomed Suleimanov from work no longer temporarily. And the amount of unpaid wages for the period of suspension from work should be recovered from the Ministry of Finance of the Russian Federation.
