The use of a distorted image of the Coat of Arms of the Russian Federation as an emblem was forbidden to the Charitable Foundation for Assistance to Convicts and Their Families “Seated Rus”. The corresponding decision was taken by the Second Cassation Court of General Jurisdiction.
As it became known to MK, the emblem is a double-headed eagle, one half of which is in a prisoner’s uniform, the other half is in a uniform with epaulettes and a cap. On the paw, which is “dressed” in a robe – shackles, in the paw on the uniform side – a police baton. Last year, a peculiar emblem attracted the attention of the Main Directorate of the Ministry of Justice of Russia for Moscow. The department noted that the use of the state symbol by the fund is a direct violation of the Federal Constitutional Law “On the State Emblem of the Russian Federation”, and issued a warning to eliminate violations. The fund’s employees ignored this warning, and after a repeated appeal to the Gagarinsky District Court with a claim to recognize the warnings as illegal and cancel them. They motivated their demands by the fact that the symbolism of the fund is not at all a desecration of the State Emblem of the Russian Federation, and in general it is not modified by the image of the coat of arms: the author of the symbolism, allegedly, “sought with the help of certain artistic techniques to emphasize his critical attitude towards the penitentiary policy that has developed in the Russian Federation “. The court disagreed with this argument and dismissed the fund’s claim. The Court of Appeal upheld the court’s decision.
The Second Court of Cassation, having familiarized itself with the materials of the case, supported the decisions of its colleagues, and recognized the warnings issued to the fund as legitimate, agreeing that the emblem really is a modified image of the State Emblem.
