She will be paid 2,000 rubles for moral damages
A resident of Podolsk sued an online delivery store for withdrawing money from her bank card without permission. Formally, no harm was done, but in fact, virtual sellers violated the law on the protection of personal data, for which they paid.
As it became known to MK, a client of a large store had long ago linked a bank card to her account and paid for purchases with it without any problems. But in July last year, Anna (name changed – author’s note) decided to use another card to pay on the Internet, and deleted the old one. However, the sellers with enviable persistence continued to withdraw money from the old card at the conclusion of the next transaction. In August alone, Anna paid for goods worth 6,763 rubles with the “wrong” credit card. Appeals to the service department were not successful – the money continued to be debited with each new purchase. Then Anna went to court.
For non-pecuniary damage, the plaintiff demanded 10,000 rubles. Although formally nothing terrible happened – after all, there was money on the card, Anna suggested that through the online store her data linked to a credit card could fall into the hands of scammers. The Podolsky court somewhat cooled the lady’s ardor and awarded her only 2,000 rubles, but ordered the online store to remove the old card number from the system.
