The Cabinet of Ministers did not support the bill on criminal liability for deepfakes

The government of the Russian Federation did not support the bill on the introduction of separate criminal liability for the distribution of deepfakes, the author of which was Sergey Leonov, an LDPR deputy, informs TASS with reference to the draft Cabinet recall on the document.
Deepfake is a technology with which you can create and change the image in photos and videos using artificial intelligence and a neural network. In particular, the tool can be used by scammers to replace a person’s face in a video or photo.
Leonov proposed introducing a new article into the Criminal Code of the Russian Federation, which provides for liability for the illegal creation or dissemination of data about people without their consent using artificial intelligence, which replaces the face and voice.
The Government Commission on Legislative Activities stated that the authors of the initiative did not take into account that “the creation of materials containing information about the private life of a person using artificial intelligence, without the purpose of their subsequent distribution, does not have a sufficient degree of public danger inherent in a crime.” The Cabinet also indicated that the illegal dissemination of personal data of citizens, including with the help of AI, already falls under the article on violation of privacy. The initiator of the bill also did not provide statistical data that would indicate the inefficiency of the current regulation.
The wordings used in the draft law “creating information about the private life of a person”, “content processing technology” do not meet the requirements of “certainty, clarity and unambiguity”.
The problem of deepfakes was outlined in October 2021 by Deputy Prime Minister Dmitry Chernyshenko. He emphasized that the use of deepfakes without the consent of the people themselves is unacceptable, and added that technologies that help recognize the substitution exist. In May 2021, Russian presidential spokesman Dmitry Peskov stated that the threat of deepfakes is “more terrible” than fake news.
