On January 15, the Russian Government Commission on Legislative Work approved a draft response to the initiative to confiscate property from those convicted of fake news about the army (270.3 of the Criminal Code) and calls for activities directed against the security of the Russian Federation (280.4 of the Criminal Code), the TV channel reported RTVIwho has a copy of the review.
According to RTVI, the bill was introduced by United Russia deputies Irina Yarovaya, Vasily Piskarev and Elena Yampolskaya. According to the initiative, the crimes provided for in Articles 280.4 of the Criminal Code and 270.3 of the Criminal Code are proposed to be added to the list of acts, as a result of which the forced and gratuitous seizure of property in favor of the state is allowed, the TV channel reports.
As RTVI reports, the bill implies that confiscation of property will be applied if these crimes were committed for money. In such cases, the document says, the instruments of crime, in particular, a phone, computer or tablet, are subject to confiscation.
The TV channel notes that in the draft government review the initiative was supported without a single comment.
In January last year, State Duma Speaker Vyacheslav Volodin offered confiscate the property of departed Russians who “allow themselves to publicly pour dirt on Russia.” He clarified that, according to Russian legislation, such statements can be regarded as calls for extremism, rehabilitation of Nazism or discrediting the armed forces. The initiative was supported by Senator Andrei Klishas.
Now in the Russian Criminal Code there is no confiscation as a form of punishment, but is used only as a measure of a criminal legal nature. That is, only property obtained by criminal means or that constitutes an instrument of crime is subject to confiscation.
