The Armed Forces of Bashkiria prepared a motivation in the case of Yuri Shevchuk on discrediting the army

The motivational part of the decision of the Supreme Court of Bashkiria (available to Kommersant) has become known, which approved the decision of the Sovetsky District Court of Ufa to recognize the leader of the rock group DDT Yuri Shevchuk guilty of discrediting the army (part 1 of article 20.3.3 of the Code of Administrative Offenses of the Russian Federation).
August 16, 2022 judge of the Sovetsky District Court of Ufa Yulia Egorova fined musician for 50 thousand rubles. The protocol against Mr. Shevchuk was drawn up by employees of the Ufa Department of the Ministry of Internal Affairs on May 18 after his concert in the Ufa-Arena complex. At the concert, Yuri Shevchuk, among other things, said: “The Motherland is not the president’s ass to procrastinate and kiss her.” The phrases “Don’t shoot” (that’s the name of one of the most famous DDT songs) and “No to war” appeared on the screens.
December 19 Supreme Court of Bashkiria left the decision of the court of first instance is in force. As reported in the decision, the appellate instance considered the conclusions of the Sovetsky District Court on the presence of an administrative offense in the actions of Yuri Shevchuk “corresponding to the actual circumstances of the case and the available evidence.” It follows from the document that the musician’s appeal to the public expresses “an obviously negative attitude towards the ongoing special military operation”, is aimed at forming among the audience “a false opinion regarding the true goals and objectives of using the Armed Forces of the Russian Federation, that is, to discredit them.”
“There are no grounds for reassessing the established circumstances and conclusions of the judge of the district court,” the decision of the Supreme Court says.
The Supreme Court also considered the size of the fine justified, noting that the object of the offense is an encroachment on public order, and the perpetrator is able to influence the opinion of “a large part of society.”
