Suspected of seducing a minor 26-year-old barmaid became pregnant from a schoolboy

The wild story of the seduction of a 26-year-old bartender of a 14-year-old schoolboy in the Kemerovo region, which surfaced a little over a month ago, received a shocking (though, in principle, not so unexpected) continuation. It has now become clear that the woman, who has been under investigation for a month, is pregnant. Around the fourth month – so much time ago, she entered into an illegal relationship with a teenager. So yes, the child is from the victim. Their friends reported it.

“MK” talked with the suspect’s acquaintances about this situation, and also found out from lawyers whether the birth of a child from a 14-year-old victim would help a woman, a mother, by the way, to avoid punishment for two children?

As MK wrote earlier, everything happened in the city of Kaltan. 26-year-old Natalya is suspected of having a relationship with a boy from her fifth grade daughter’s school. She herself, we note, gave birth to her at the age of 14. In addition to her daughter, she also has a small son. The woman is divorced, she used to work in a beer store as a saleswoman and bartender, and recently moved to the same position in another institution.

Our interlocutor, a resident of Kaltan, knows both of them – she often crossed paths with Natalia and 14-year-old Andrei (his name has been changed – author) in a common company. The teenager himself does not differ in exemplary behavior: he skips school, smokes, swears … The guy graduated from the sixth grade, but is older than his classmates: he stayed twice for the second year. In his company, he is the youngest, but he tries to “keep up” with adult “comrades”: he drinks on a par with them. “Mom doesn’t follow him at all and doesn’t educate him, she doesn’t care,” say the residents. The guy has a mother, a stepfather, a 17-year-old sister and a 7-year-old brother.

A girl who knows both defendants told us that Natalya had a relationship with a sixth grader for about three months before the connection became the property of law enforcement agencies. As our interlocutor says, Andrei’s friend “surrendered” them to the police.

On April 10, a criminal case was opened against a woman for sexual relations with a person under the age of 16.

All this time she has been at home under house arrest, and not in a pre-trial detention center, and, as her friends say, she continues to go to work.

All the residents with whom we spoke are shocked by this situation. Moreover, given the fact that the suspect has two small children … Everyone, without exception, angrily condemns her and would like her to be held responsible for seducing a teenager. And then there’s this twist…

The events that followed do not fit into my head, but friends and acquaintances told us that their relationship was not interrupted even after the initiation of a criminal case. And now it has also become clear that Natalya is pregnant.

“They want to sign,” Andrey’s friend told us the news. – I asked the inspector of the PDN, who is registered with Andrei, she said that if they get married, she will not be imprisoned. The investigation is still ongoing. Surely, she will take a paternity test, but no one doubts that the child is from Andrey, and he himself has no doubts either. Natalya told everyone that she would give birth.

– It turns out that these illegal relations continue?

– Yes. I saw the broadcasts that Andrey recently posted on his VKontakte page – this is a gesture. He drinks beer with her, they kiss on camera … We are all in shock here, they drink almost every day, and she has small children who look at all this … Andrey’s mother is not against the fact that they live together, he moved her. At the age of 14, this is incomprehensible to the mind! But his mother doesn’t care about her son.

– Yes, it’s true, they live together, she is pregnant, – another friend of Andrey confirmed to MK. “Everyone around here thinks she can get away with a criminal case.

– And what about Andrew himself?

– He told everyone that he was ready for adulthood and would raise his child. I am horrified by this situation, as are many in our city.

The author of these lines also fell into bewilderment and turned to a lawyer for comments.

– The maximum punishment under the article of the Criminal Code of the Russian Federation for sexual intercourse with a person under the age of 16 is 4 years, – says Stalin’s lawyer Gurevich. – The punishment will be determined by the court, taking into account all the circumstances, including, for example, whether the boy had sexual experience before the suspect, how active his actions were, etc.

There is a note to this article (sexual intercourse with a person under the age of 16) – a person who has committed a crime for the first time … is released by the court from punishment if it is established that this person and the crime he committed have ceased to be socially dangerous due to entry into marriage to the victim.

However, it is unlikely that the suspect will be able to use this note and free himself from criminal liability, since under Russian law the procedure and grounds for marriage under 16 years of age is determined by regional legislation. On the territory of the Kemerovo region, this issue is not regulated by law.

If she gives birth before trial, she may be granted a reprieve from her sentence.

– Remind me what it means to be “under house arrest”? Does she need to show up somewhere?

– You don’t have to mark it. The suspect is obliged to appear on the first call and not to leave or change her place of residence without the permission of the investigator. That is, do not move anywhere. Under a written undertaking not to leave, people can continue to go to work.

On our own behalf, we’ll add what we learned from the vastness of the Web: the family code allows, under special circumstances, as an exception, marriage registration before the age of 16 years. Currently, such a law has been adopted in some regions of the Russian Federation, and in practice the minimum age for marriage is 14 years. In some regions, the minimum age for marriage is set at 15 years.
