As MK was told in the joint press service of the judicial system of St. Petersburg, the case was considered by the Kuibyshev city court due to the fact that the management company of the outlet is located in the northern capital. This case is interesting for its comedy. A resident of Tatarstan bought a pack of dumplings in a store. After paying for it, he decided to check the expiration date of his purchase. Unfortunately, he saw that the goods were expired. The frustrated buyer returned to the checkout, where he was returned the money, but the unpleasant aftertaste remained. According to the citizen, the sale of low-quality and dangerous goods caused him moral suffering. They, in particular, expressed themselves in disrespect for him as a consumer, in his feelings on this occasion. He was also worried about the general food safety of the population, so he filed a claim for non-pecuniary damage, which he estimated at 1,000 rubles.
The court considered the fact of violation of the plaintiff’s rights as a consumer established. This became a sufficient basis for a positive decision on the issue of compensation for moral damage to the consumer. The company was charged 1000 rubles as compensation and 500 rubles fine.
