Three new articles about animals will appear in the Code of Administrative Offenses by the summer

The Duma Committee on State Building and Legislation has prepared for the second, decisive reading of the so-called. bill on bites. If it came to the dog causing frivolous harm to the life or health of a person or his property, the owner will be fined a maximum of 30 thousand rubles. The authors believe that these measures will work even without registration of pets.

The bill was submitted to the State Duma in 2021, adopted in the first reading and was preparing for the second, but in the summer of 2022, when the authorities abandoned the idea of ​​introducing mandatory registration of pets, it fell into a long drawer. In the spring of 2023, when an initiative was being discussed to allow regions to introduce their own rules for the treatment of stray animals on their territory, the participants in the discussion recalled that in Russia there are no federal penalties for irresponsible owners, because of which dogs end up on the street and sometimes attack of people. That old bill was taken out of the long box, finalized, and in the coming days it may become law.

We are talking about supplementing the Code of Administrative Offenses with three new articles. One of them, in particular, proposes to punish citizens who abuse animals with fines from 5 to 15 thousand rubles, but not so cruelly as to initiate a criminal case (that is, if the animal was not killed, not maimed, but “simply” beaten or starved). Officials for this will be fined 15-30 thousand rubles, legal entities – 50-100 thousand rubles. But if the violation of the requirements for the treatment of animals caused “harm to the life or health of citizens” or their property, but does not contain signs of a criminal offense, the fine for citizens will be from 10 to 30 thousand rubles, for officials from 50 to 100 thousand rubles, and for legal entities – from 100 to 200 thousand rubles.

However, the owner of the animal will not be punished if, at the time of the harm, the dog was under the supervision of another person or was stolen, and the chip indicates the previous owner.

Recall: in Russia, an attack by a dog or any other animal on a person is considered a criminal offense, which ended not in torn clothes, fright or a frivolous bite, but infliction of grievous bodily harm or death through negligence.

By the way, if we talk about pets, the law “On Responsible Treatment of Animals” establishes, among other things, such general requirements for their walking as a ban on “free, uncontrolled” movement when crossing highways, in elevators and entrances of apartment buildings, in courtyards such houses, on children’s and sports grounds (that is, a leash is required) and the obligation of the owner to clean up waste products after their pets in places and in common areas. Regions may establish additional requirements for the maintenance of pets, “including their walking” …

Two other new articles of the Code of Administrative Offenses contain penalties for violating the requirements for the use of animals for cultural and entertainment purposes and for those (including officials) who violate the requirements for keeping animals in shelters and the rules for handling animals without owners.

Reports of offenses will be able to draw up officials of Rosselkhoznadzor, Rosprirodnadzor and some regional executive authorities.

But is there any point in such a law without mandatory registration? Who and how will prove the fact of violation? One of the authors, the first deputy head of the Committee on Ecology, Natural Resources and Environmental Protection, Vladimir Burmatov (ER), in a conversation with MK, recalled that right now the authorities are being transferred to the regions to register pets on their territory, and the police, which under the new articles of the Code of Administrative Offenses, protocols will not be drawn up; when citizens apply, she herself can transfer materials to the address if she does not see grounds for initiating a criminal case. According to the deputy, the meaning of the bill is to be able to punish offenses that do not amount to a crime, but are quite real and even fixed: “The owner releases a large dog without a leash next to the playground, it frightened the child, it’s good if it didn’t bite, – What should parents do? Nothing today, even if the dog is microchipped, there is a surveillance camera and several witnesses…”. Mr. Burmatov says he receives hundreds of such requests daily.

The first deputy head of the Committee on State Building and Legislation, Yuri Sinelshchikov (KPRF), confirmed to MK that “there are a lot of applications.” “You can’t do nothing, you have to strive for at least some kind of order, although the bill still turned out to be contradictory,” he said.
