A bill against fictitious paternity was developed and submitted to the lower house of the federal parliament by the Bryansk Regional Duma. In accordance with it, foreign citizens and stateless persons will be able to establish paternity of minor citizens only through the court.
The developers of the document note that today the legislation allows establishing the paternity of a man who is not married to the child’s mother by submitting an application to the registry office. If only one of the parents wants to establish paternity, the issue is resolved through the court.
At the same time, the presence of a child – a citizen of Russia, permanently residing in the territory of our country – is a sufficient basis for obtaining a residence permit in a simplified manner. Practice shows that foreigners often seek to establish paternity precisely to legalize their stay in Russia, without intending to raise and support a child. According to the Civil Registry Office of the Bryansk Region, in 2022, citizens of Afghanistan, Nepal, India, Tajikistan, Uzbekistan, China, Syria and a number of other countries established their paternity in relation to minor residents of the region. The adoption of the law proposed by the Bryansk Duma will complicate this procedure.
