Rosreestr continues to expand the powers of the public law company (PPK) Roskadastr to manage data in the field of land and real estate and proposes to transfer to it, from January 1, 2024, the authority to maintain the state cadastral valuation data fund. At the same time, the work of the PPC itself in relation to GKOs will remain under the control of Rosreestr. The delegation of authority will allow the service to focus on the global tasks of geodata digitalization to improve the efficiency of public administration, while the transfer of functions to Roscadastre, as promised, will be accompanied by an increase in the availability of services to challenge sensitive results of cadastral valuation. In the future, businesses and citizens will be able to do this on the National Spatial Data System platform.

From January 1, 2024, Rosreestr is ready to delegate the authority to maintain the state cadastral valuation data fund (GKO) to the PPK Roskadastr from January 1, 2024, follows from the bill published on regulation.gov.ru. Now Rosreestr is doing this on its own, while work on GKOs is carried out by budgetary institutions appointed in the regions – they are the source of the fund’s data. The department monitors the work of the authorized regional bodies and budgetary institutions for the correctness, completeness and timeliness of the execution of their powers. In the new design, Rosreestr will extend such monitoring to the PPK Roskadastr.

The amendments de facto divide the work with data into two parts: content and regulation. Rosreestr transfers the first direction to a subordinate state company, and reserves the second.

The transfer of new powers to the PPC fits into the logic of optimizing state administration in the field of land and real estate. “Roskadastr”, recall, was created in 2021 as a full-cycle state-owned company, which was supposed to take over the infrastructure and execution of the market functions of Rosreestr. In particular, the PPC inherited the powers of the budgetary institutions “FKP Rosreestr” and “Center for Geodesy, Cartography and Spatial Data” and the joint-stock companies “Rostekhinventarizatsiya – BTI” and “Roskartografiya”. Recently, Rosreestr also proposed to transfer to Roscadastre the implementation of all complex cadastral works at the expense of the federal budget, which are now carried out by market players under government contracts in the regions (see “Kommersant” dated August 9).

The concentration of powers in the PPK Roskadastr is explained by the need to implement large-scale government plans to digitalize all geodata in the Russian Federation – about land and real estate, information about rights and about cadastral valuation – on a single digital platform “National System of Spatial Data” (NSDS). In order for the system to receive high-quality data, Rosreestr is also improving its work on the ground: for example, the authorities synchronized the holding of GKOs in the regions. At the end of 2022, a single GKO cycle was completed according to a single methodology, whereas earlier the regions made decisions on recalculating the cadastral value on their own and the data could not be updated for years, which negatively affected budget revenues.

The draft law of Rosreestr provides that Roscadastre will maintain a fund of GKO data using the NSPD platform, of which it is the operator. In the future, this will improve the quality of services provided to business and the state.

Now, for example, citizens and businesses can challenge the results of the cadastral value, but they have to submit declarations in person or by mail. Meanwhile, the cadastral value is used to calculate property taxes, rent for land in state or municipal ownership, and to determine the state duty. The bill introduces the possibility from January 2024 to use the NSPD digital platform for filing declarations on the characteristics of a property, comments on determining the cadastral value and requests for appropriate clarifications, applications for correcting errors in determining the cadastral value and establishing the market value.

Interest in the sphere of land and real estate is explained by the state’s need for capital investments and effective development of territories. For example, by June 2023, the Rosreestr project “Land for Tourism” made it possible to identify 349 sites with an area of ​​almost 4 thousand hectares suitable for tourism needs in 38 regions. The availability of data on such sites in electronic form – and the project will become a service for NSPD – simplifies the work of investors.
