Redevelopment according to new rules in Moscow

You started a major overhaul, in which you really want to change the space, install a shower cabin instead of a bathtub, or even completely move a non-main wall, increasing the usable area. But if you remember how many ordeals you need to go through in order to collect and coordinate all the stages of redevelopment, your hands drop. Now do not despair! Important changes in the coordination of redevelopment of premises in apartment buildingssignificantly simplified the approval process. We will talk about some innovations in this material.

By decision of the Mayor of Moscow, until December 31, 2022, a moratorium was introduced on the imposition of administrative fines upon approval of work already completed on the redevelopment and reconstruction of premises in apartment buildings. Namely: now there is no need to coordinate the project with the Moscow Architecture Committee if the appearance of the house changes, for example, in the case of installing new windows. This made it possible to reduce the period of public services by 10 days, from 30 to 20.

The validity period of the decision on the approval of the reorganization and (or) redevelopment has been increased to 18 months.

The number of members of the acceptance committee has been reduced from four to two – the inspector of the Moscow Housing Inspection and the applicant. The participation of representatives of the design organization in the work of the acceptance committee is required only if the supporting structures were affected during the reconstruction and redevelopment.

According to the new requirements, acceptance of works with minor deviations from the agreed design solution is allowed. If deviations were made during the performance of work that did not affect the common property, load-bearing structures, arrangement or change in the boundaries of bathrooms, it is enough for the applicant to provide a sketch of the final configuration of the room, which he can perform independently.

The requirement to submit a contract for the placement of non-capital facilities, which was previously required when carrying out work on the arrangement of entrance groups of non-residential premises, has been cancelled.

It is not necessary to provide a protocol of the general meeting of owners of premises during work affecting common property, if it was previously transferred to the Moscow Housing Inspectorate in accordance with the established procedure.

Also this year, at the initiative of the Moscow Housing Inspection, the requirements for the redevelopment of bathrooms were updated, amendments were made to the Code of Rules SP 29.13330.2011 “SNiP 2.03.13-88 Floors” and 30.13330.2020 “Internal water supply and sewerage of buildings”.

Muscovites in their bathrooms may not install overflow sills, provided that the floor is waterproofed in the entire apartment or a leak protection system is installed. In this case, the implementation of waterproofing must be recorded in an act of hidden work.

The ban on the installation of a shower drain has also been lifted under the conditions of waterproofing the premises and not affecting the supporting structures. Previously, ladders were not allowed.

In the case of work to replace the bathtub with a shower with a ladder (within the existing boundaries of the bathroom), the owners do not need to develop project documentation, as well as prior approval from the Moscow Housing Inspection.

Of course, the new set of redevelopment rules, although it simplifies the procedure for its approval, does not relieve the owner of responsibility for the repairs carried out in the apartment.
