RBC: The Ministry of Industry and Trade proposed to limit foreign purchases at the legislative level

The Ministry of Industry and Trade considers it necessary to enshrine in the law the norms on establishing restrictions or prohibitions on the purchase of foreign goods, reports RBC with reference to the letter of the department sent in response to the relevant request of the Spetsavtoprom association. Now restrictions on the purchase of foreign goods and services are regulated by government regulations.

As RBC clarifies, the department intends to amend the federal law “On the Procurement of Goods, Works, Services by Certain Types of Legal Entities”, which regulates the procurement of state-owned companies, since the current by-laws are not enough.

From the letter of the Ministry of Industry and Trade, which is at the disposal of RBC, it follows that such amendments are necessary to form a general scheme for confirming the country of origin, as well as “in connection with the current economic situation” caused by Western sanctions. The agency proposes to legislate restrictions on the admission of goods from foreign countries, works and services performed by citizens of other countries.

The press service of the Ministry of Industry and Trade reported that it had sent proposals to amend the procurement law to the Ministry of Finance. In August, the Ministry of Finance responded that these proposals had previously been considered several times and “did not pass interdepartmental coordination.”

According to the price priority under the current law, if the purchase of a state-owned company takes place in the format of a tender and Russian and foreign companies participate in it, then when comparing bids, it considers the price of a supplier from Russia as if he offered it 15% lower. If a supplier from Russia wins, the contract is signed with him at the offer price, excluding this discount. If the purchase takes place in the auction format and a foreign supplier wins, then the contract with him is signed with a 15% discount.

Earlier, manufacturers of special equipment sent a letter to the government, in which they proposed to increase the price priority from 15% to 65% for manufacturers from Russia against the backdrop of a strengthening ruble. Denis Kudryavtsev, director general of the Spetsavtoprom association, asked that the development of this project be entrusted to the Ministry of Industry and Trade and the Ministry of Economic Development.
