Putin prepared amendments on informing the Council of Europe about martial law

Russian President Vladimir Putin is submitting amendments to the State Duma related to informing the UN and the Council of Europe regarding the military and state of emergency in the Russian Federation. This follows from the order of the head of state on the appointment of Deputy Foreign Minister Alexander Grushko as an official representative when considering the bill in parliament.
According to the document which published on the portal of legal acts, amendments are proposed to be made to Art. 37 “On the state of emergency” and Art. 22 “On martial law”.
Art. 37 of the Federal Law “On the state of emergency” provides that the federal executive body in charge of foreign affairs must notify the secretaries general of the UN and the Council of Europe within three days of the introduction of a state of emergency in Russia, of temporary restrictions on the rights and freedoms of citizens and the reasons for such a decision . When this regime ends, the authorities must also notify organizations of this.
In Art. 22 of the Federal Law “On martial law” states that in the event of the introduction of martial law on the territory of Russia or in certain areas, the president is obliged to take measures to notify the UN Secretary General, and through him the members of the organization, and the Council of Europe about “the withdrawal of the Russian Federation from its obligations under international treaties related to the restriction of the rights and freedoms of citizens. Also, the head of state must provide information about the date from which martial law will be terminated.
On February 25, 2022, the Council of Europe decided to limit Russia’s rights in the organization due to a special military operation in Ukraine, then the Committee of Ministers decided to immediately exclude Russia. In March, Russia announced its withdrawal from the Council of Europe and start the appropriate procedure.
On October 9, 2022, Russian President Vladimir Putin signed a decree on the introduction of martial law in the Donetsk and Luhansk People’s Republics, Zaporozhye and Kherson regions after they became part of Russia.
