The mere statement that military service is contrary to one’s beliefs cannot justify its replacement by alternative civilian service. This decision was made by the Third Arbitration Court of General Jurisdiction, located in St. Petersburg, having considered the case of a citizen who declared himself a pacifist.
As the press service of the court told MK, the young man applied to his district military registration and enlistment office with a statement, which, in particular, stated that his beliefs were contrary to military service and that he considered any war to be unreasonable, immoral and unjustifiable. Therefore, he asked to replace the military service with an alternative civilian one. The draft commission did not satisfy the petition: the Petersburger was explained that he had applied late. But the citizen was not satisfied with such an answer and went to court. The court of first instance recognized the refusal of the military registration and enlistment office as justified, in the court of appeal the decision of the colleagues was left unchanged. The plaintiff was explained that according to the law “On Alternative Civilian Service”, citizens who should be called up in October-December have the right to apply for the replacement of military service by conscription with alternative civilian service before April 1 of the current year. The law also states that those wishing to serve in a “civilian” must justify that military service is contrary to their beliefs or religion.
Then the pacifist turned to the court of cassation, but there he was told that one application was not enough, those who did not want to go into the army should “provide facts that testified to well-formed convictions, and also provide evidence of their arguments.” Meanwhile, the only “evidence” of the pacifism of the pre-conscript was a characterization from the university where he had previously studied, generally positive, but without indicating that the young man was fond of pacifist ideas. The military registration and enlistment office also reported that when registering for military registration, the citizen did not notify the employees of the commissariat about how much he hates the war. Therefore, the cassation appeal was denied to him.
