Parliamentarians proposed to allow combining an apartment with a loggia without unnecessary formalities

Now this needs to be coordinated with the neighbors.

Allow to combine the loggia with the apartment, without asking permission from all the neighbors, proposed the legislators of Stavropol. On Thursday, March 9, the draft law was submitted by the Duma of the Stavropol Territory to the lower house of the Federal Assembly.

Today, loggias are officially considered common property, along with stairwells, basements, elevators, etc. Therefore, no matter how absurd it may seem, making your own loggia part of the apartment is possible only with the permission of 100% of the owners of the apartment building. After this decision is made, a citizen who wants to expand the living space at the expense of the loggia must apply for permission for redevelopment to the local government.

As it became known to “MK”, after analyzing the practice of their own and neighboring regions, the legislators of the Stavropol Territory found that denials of such permits are a fairly common practice. So, over the past year and a half in Astrakhan, due to the lack of a protocol of a general meeting of owners of premises in a house or the required number of votes of owners, 96 decisions were made to refuse to agree on redevelopment in Cherkessk – 39, in Vladikavkaz – 5, in Samara – 16, in Makhachkala – 11. In the Stavropol Territory for the same year and a half, 52 families received a refusal for the same. The only exception was Krasnodar, the administration of which does not consider the lack of a protocol of the meeting of owners who unanimously voted to allow neighbors to improve living conditions to be a sufficient reason for refusing to combine a loggia with an apartment. The Stavropol people intend to extend this practice to the whole of Russia.
