Parliamentarians propose to change the order of inheritance of housing acquired by the deceased members of the SVO

Deputies of the Tambov Regional Duma proposed to determine the features of the inheritance of real estate acquired by the military who died during a special military operation. Today, the relevant bill was submitted to the lower house of the federal parliament.

In accordance with the Federal Law “On the Accumulative Mortgage System of Housing for Military Personnel”, one of the grounds for excluding a military man from the register of participants in the system is death or death, recognition of him as missing in the manner prescribed by law, or declaration of his death. The law also determines that in this case, all mortgage savings made by him during his lifetime can be used by his family to improve their living conditions. The law, in particular, refers to its members the spouse, minor children, persons who were dependent on a military man. If the deceased has no children of the listed categories, no spouse, no dependents, his parents (trustees) and adult children inherit the savings. At the same time, the law does not determine the order of inheritance of housing if it was acquired under the program, that is, it is inherited in accordance with the Civil Code (the heirs of the first stage are children, spouse and parents, the second – grandparents, brothers and sisters). According to the Tambov legislators, this rule should be changed for the relatives of servicemen who died while performing tasks during the SVO or who later died from injuries and injuries. If the law developed by parliamentarians is adopted, the property acquired by the deceased will be inherited in the same way as savings. We are talking about apartments, their parts, land plots. They will be inherited by family members in the composition determined by the law on the military savings and mortgage system, and in the absence of it, by parents and adult children.
