Parliament of Tatarstan asks not to exempt mobilized from paying alimony

At a meeting on November 18, the State Council of Tatarstan adopted an appeal to the Speaker of the State Duma Vyacheslav Volodin with a request to initiate changes to the federal law “On Enforcement Proceedings”. The deputies ask that the deferrals provided by law for the payment of alimony do not apply to “those called up for military service for mobilization in the Armed Forces of the Russian Federation.”

As explained by the head of the State Council Committee on Social Policy Svetlana Zakharova (“United Russia”), now the mobilized have the status of military personnel. This means that the recovery of alimony from them “is subject to suspension by the bailiff in whole or in part in the event that the debtor participates in hostilities as part of the Armed Forces of the Russian Federation,” as well as when “the debtor performs tasks in a state of emergency or martial law, armed conflict.” Enforcement proceedings may be suspended at the request of the debtor, who is doing military service by conscription, she explained. “Underage children or disabled parents who need help are deprived of material support,” the deputy expressed concern. She added that “receiving regular support payments can be one of the main sources of livelihood.”

“This issue requires an immediate solution in favor of the children and parents of the debtors,” the State Council of Tatarstan believes. Earlier, mothers of underage children, who receive alimony from the mobilized, applied there on this issue, the appeal to Mr. Volodin says.

“In order to resolve the issue, it is necessary to make changes to the federal law “On Enforcement Proceedings”, in accordance with which enforcement proceedings for the recovery of alimony from citizens called up for military service for mobilization will not be suspended,” said Ms. Zakharova.

Recall that at the end of October, the State Duma received a bill on the suspension of legal proceedings against volunteers and mobilized. Judicial and enforcement proceedings against those mobilized should be suspended as soon as they signed up as volunteers or were called on the agenda, explained one of the authors of the bill, First Deputy Chairman of the Federation Council, Secretary of the General Council of United Russia Andrei Turchak. The State Duma noted that “the suspension of proceedings will not affect cases of alimony obligations and obligations for compensation for harm in connection with the death of the breadwinner.”
