Oryol deputies proposed imprisonment for malicious evasion of court-appointed treatment for drug addiction

The Oryol Regional Council of People’s Deputies proposed to introduce a new article into the Criminal Code (CC) of the Russian Federation, according to which one can get a real term for malicious evasion of drug addiction treatment. We are talking about treatment ordered by the court, the relevant bill introduced to the State Duma. TASS notes that the document was introduced without official reviews of the government and the Supreme Court of the Russian Federation, which are mandatory if the initiative provides for amendments to the Criminal Code.

“The malicious evasion of a person from fulfilling the obligation imposed by the court to undergo diagnostics, preventive measures, treatment for drug addiction and (or) medical and (or) social rehabilitation is punishable by compulsory labor for a term of up to two hundred hours, or correctional labor for a term of up to six months, or restriction freedom for a term of up to one year, or imprisonment for the same term,” the draft law proposes.

A malicious evader from treatment for drug addiction, which was appointed by the court, is proposed to be considered a person who has previously been subjected to administrative punishment for this at least three times. Since now a person evading drug treatment can be brought to administrative responsibility repeatedly, the violation can be repeated indefinitely, the authors of the bill explain.

A law that gave courts the power to order anti-drug procedures was passed in November 2013for the six months of 2022, 261 administrative protocols for illegal drug use were drawn up in the Oryol region, the statistics are given in the explanatory note.
