Offended manicurist sues colleague over internet videos

The conflict between two former manicure colleagues over publications on the social network ended in a trial in the Dolgoprudnensky court. First, the girls posted humorous videos on the salon’s website to attract customers. Then one of them changed her mind and demanded that her friend delete the posts and pay a fine for allegedly posting her image without permission.

As MK found out, manicure master Inna Ivanova (all names have been changed) sued her former colleague and demanded that 14 videos with her participation be removed from social networks. The woman also asked to compensate her for non-pecuniary damage in the amount of 400,000 rubles and legal expenses in the amount of more than 80,000 rubles. The beauty specialist explained that the recordings were made solely for personal use, and a colleague posted them on social networks without her consent.

However, other circumstances emerged at the hearing. Defendant Oksana Orlova told the court that Inna was trained in nail service by her. After training, the girls decided to shoot comic commercials with the participation of Inna on the topic of manicure in order to attract new customers. Oksana confirmed that she posted these videos on the salon’s Internet account. However, the master insisted that the stories were filmed exclusively with the consent of the plaintiff and were also published with her permission. As evidence, Oksana provided correspondence in the messenger. In addition, the manicurist explained that a colleague “liked” videos with her participation, left positive comments and even posted them on her page. This was also confirmed by other employees of the salon, who were witnesses.

The reason for the court was the conflict between the masters. Inna decided to annoy her ex-girlfriend and expose her as a violator of the law. In court, the plaintiff insisted that she had withdrawn her consent to posting the videos. However, she was unable to provide evidence of this.

Since a citizen can revoke his consent at any time, the court ordered Oksana to delete the videos that contain Inna’s image. But the plaintiff was denied the rest of the claims: Oksana will not have to pay her ex-colleague either compensation for moral damage or legal expenses.
