Moscow court begins bankruptcy proceedings for Radio Liberty

The Moscow Arbitration Court, at the request of the Inspectorate of the Federal Tax Service (FTS) No. 7, bypassing the stages of financial recovery and external management, introduced a monitoring procedure in relation to Radio Free Europe / Radio Liberty LLC – the legal entity of Radio Liberty (included in the register of foreign agents) in within the bankruptcy case. The tax debt of the broadcasting organization is about 7 million rubles.

The application for bankruptcy of Radio Liberty was submitted to the court on March 4. Initially, it was accepted for production under a simplified procedure. As TASS clarifies, during the court session, the Federal Tax Service refused to bankrupt the debtor under a simplified scheme and petitioned for the introduction of supervision, explaining that the debtor has property that can be used to pay for the bankruptcy procedure.

The representative of the radio station stated that in this case a new subject of requirements is being declared. “I believe that we have a new lawsuit, a new application that cannot be considered, since a moratorium (on bankruptcy) has now been introduced,” she said.

She also stated that, according to the requirements of the media law, the existence of a Russian legal entity is mandatory for foreign media agents, so Radio Free Europe/Radio Liberty LLC cannot be declared bankrupt.

The court appointed the consideration of the bankruptcy case of the organization on February 6, 2023.

According to Interfax, since the beginning of 2021, Roskomnadzor has drawn up 1,044 protocols against Radio Free Europe/Radio Liberty LLC due to the lack of marking. According to the court decision, 938 decisions came into force for a total of 785.9 million rubles. This year, the company was fined 75.8 million rubles for refusing to remove “false information about the military operation in Ukraine”. The total amount of fines assigned to the broadcasting organization amounted to 1 billion 64.3 million rubles.

In May last year, Radio Liberty reported that the bank accounts of its Moscow branch had been blocked.
