Mikhail Khachaturian, who was killed by his three daughters, was posthumously charged with a new charge

The investigation has re-indicted the late Mikhail Khachaturian, who was brutally murdered by his three daughters in Moscow in July 2018, for violence. Earlier, the Khachaturian sisters announced the torture and corruption of their father, and the relatives of the murdered man protested the formal termination of the criminal case and are trying to prove that the words of the parricides are a lie.

Recall that three sisters, one of whom was a minor at the time of the murder, brutally dealt with their father: they attacked a man when he was sleeping and killed him with a gas canister, a hammer and a hunting knife. After the sisters spoke about the violence from their father, these materials were separated into a separate production. According to the results of the pre-investigation check, the criminal case against the late Mikhail Khachaturyan was not initiated in connection with the death, and accusations of violence without evidence were used as an established fact. This is possible under the law, but, as MK has already reported, a decision to refuse to initiate a criminal case with such wording is not a rehabilitating ground for the suspect. The investigator could refuse to open a criminal case only with the consent of Mikhail Khachaturian’s relatives.

The sister of the late Nair filed a complaint with the court, stating that no one took any consent from her, and she intends to prove her brother’s innocence. Meanwhile, information about the alleged systematic crimes of Mikhail Khachaturian (violence, including sexual, and torture) against his daughters formed the basis of the indictment in the murder case and was presented as the main motive for the massacre of the “domestic tyrant”.

In this form, the case reached the court, the parties even unsuccessfully tried several times to choose a jury. But both cases, including those against the younger sister accused of murdering her father, separated into a separate proceeding, were “turned up”. After all, in fact, the accusations against Mikhail Khachaturian by his daughters were not investigated, and his guilt in the crimes was not proven.

Themis recognized the actions of the senior investigator for especially important cases of the Main Investigative Committee of the ICR as illegal. At the initiative of Mikhail Khachaturian’s relatives, a posthumous criminal case was initiated in March 2021. At the end of March, the relatives of the deceased were acquainted with the decision to bring him on as a defendant. The document contains “old” diagnoses and accusations taken from the testimony of the Khachaturian sisters. None of the seven episodes is scheduled: each paragraph contains standard wording about an unspecified time and place. According to the decree, the father killed by his daughters is currently officially charged with three episodes under the article of the Criminal Code of the Russian Federation “Forcible acts of a sexual nature”, three episodes under the article of the Criminal Code of the Russian Federation “Compulsion to act of a sexual nature”, under the article “Torture” and the article “Illegal production and circulation of pornographic materials or objects”.

As MK managed to find out, in August of this year, the Prosecutor General’s Office, represented by Anatoly Razinkin, the first deputy of the Prosecutor General’s Office, returned the posthumous criminal case against Mikhail Khachaturyan back to the investigator. In the relevant resolution, the supervisory authority points to gross violations. Thus, the accusation is unspecified, not based on evidence, does not correspond to the actual circumstances. Razinkin draws attention to the lack of established time and place of the crimes, raises the question of jurisdiction (some episodes allegedly took place in other countries – in Armenia, Israel), to the incorrect qualification of the actions of the accused, but in general the question arises of whether the event took place crimes in general. About all this earlier and repeatedly wrote “MK”.

In addition, the prosecutor’s office noted that the materials from the 2018 murder case form the basis of the criminal case, pointing out to the investigator the unreasonable lengthy nature of the investigation.

According to MK, a representative of Mikhail Khachaturian’s relatives, lawyer Georgy Chuguashvili, the other day the investigator filed a new version of the charge.

True, according to the lawyer, nothing was added to the case file, and the clarifications on the places and time of the crimes were again entered from the words of the Khachaturian sisters and were not verified in any way by the investigative process.
