The term of detention in a pre-trial detention center should be limited to one year, said the speaker of the Federation Council Valentina Matviyenko. According to her, there must be “very serious arguments” for the court to decide to extend the term of keeping a person in a pre-trial detention center.
“In my opinion, it should be a year. A year is enough to complete the investigation, the guilt of this person must be confirmed by evidence. And either the case is filed with the court and a court decision is made, or the measure of restraint is changed for the person, ”said Ms. Matvienko (quoted by TASS).
The speaker of the Federation Council said that in order to introduce this measure, consultations must first be held with the Supreme Court, the prosecutor’s office and the Ministry of Justice.
Now the period of detention in the SIZO during the investigation is two months. The court can extend it up to six months, for serious crimes up to 12 months, for especially serious crimes up to 18 months. The term of detention in a pre-trial detention center during the consideration of a criminal case in court is up to six months. However, the court may extend the term an unlimited number of times. In particular, journalist Ivan Safronov was in Lefortovo for more than two years.
