On Thursday, the Basmanny Court of Moscow placed house arrest on the ex-editor of Channel One, Marina Ovsyannikova. She is charged with “disseminating knowingly false information” about the Russian army – moreover, committed “on the grounds of political, ideological, racial, national or religious hatred” (clause “d” part 2 of article 207.3 of the Criminal Code of the Russian Federation). Under this article, a woman faces up to 10 years in prison. The selection of a measure of restraint at the request of the investigation took place behind closed doors. Marina Ovsyannikova’s defense believes that the investigation’s demand for house arrest was not justified.
The criminal prosecution of Marina Ovsyannikova became known on the morning of August 10: her lawyer Dmitry Zakhvatov reported about the searches at the trustee and her relatives. “The security forces refused to wait for the lawyer and broke into the house,” Mr. Zakhvatov emphasized. As it turned out, the criminal case was connected with a single picket by Marina Ovsyannikova, which took place on July 15. Then she went to Sofiyskaya Embankment – opposite the Kremlin – with a poster criticizing President Putin, and comparing “his soldiers” with “fascists.”
After the searches, Marina Ovsyannikova was taken to the Investigative Committee of Russia (TFR) for an interrogation that lasted several hours. Then she was charged and left for the night in the temporary detention center on Petrovka. Today, she was taken to the Basmanny District Court of Moscow to choose a preventive measure, and eight escorts accompanied the woman to the hall, Mediazona emphasizes (included in the register of foreign agents). Already in the “aquarium” a woman unfolded a poster “Let the murdered children dream of you at night.” After that, bailiffs blocked her, and photojournalists were removed from the hall.
The investigation petitioned for the appointment of Marina Ovsyannikova house arrest.
In addition, investigator Alyaudinov demanded that the meeting be closed, explaining that “not all evidence in the case has been collected, it is necessary to keep the secrecy of the investigation.” Marina Ovsyannikova disagreed.
She stated that the trial should be held as publicly as possible: “Only then can we come to some kind of fair decision.” Mr. Zakhvatov emphasized that his client does not deny the fact of holding a picket, which means that the materials of the case cannot be secret. Nevertheless, Judge Dudar closed the meeting.
At 17:00 the judge returned to the hall and announced the decision. Marina Ovsyannikova was placed under house arrest until December 9, 2022. Marina Ovsyannikova shouted out at the same time: “A piece of paper has become more dangerous than a gun in this country! They take my paper and pens!”
“House arrest for a solitary anti-war picket… I don’t even know what to say,” Zakhvatov’s lawyer wrote on social media right after that. “It’s good that I’m not on guard? Certainly good. But it’s still nauseating.”
“We demanded in principle to refuse to satisfy the investigation’s petition for house arrest,” Dmitry Zakhvatov explained to Kommersant. “Because what is happening against Marina Vladimirovna Ovsyannikova is legal nihilism on the part of the investigating authorities and those who are persecuting her.”
According to the lawyer, “in order to choose any measure of restraint against any person, a combination of circumstances is necessary. Involvement in the crime must be absolutely established – and what she did does not contain signs of a crime in accordance with Art. 14 of the Criminal Code of the Russian Federation (“The concept of a crime.”— “b”)”.
“In addition, it is necessary that there be evidence that a person has the intention to hide, threaten witnesses – which are not in this case. That he can destroy the evidence – which in this case has already been collected and attached. But the investigator did not prove anything – he simply filed a petition for a measure of restraint. It all looks creepy (embarrassing.— “b”). It’s just that people don’t quite know how to behave, they’re not quite professional, they don’t quite understand what they are doing and why,” says Mr. Zakhvatov.
The lawyer added that “Marina Vladimirovna feels fine, her mood is fighting.”
Recall, Marina Ovsyannikova became known on March 14 this year. Then she got on the air behind the back of the leading news program Ekaterina Andreeva. Marina Ovsyannikova held up a poster with the flags of Russia and Ukraine, as well as anti-war slogans in English and Russian. She managed to shout out a call to stop the military operation several times – using a different word. Three seconds later, the picture from the studio was replaced by the intro of the news block.
Later, a video message, which the woman recorded the day before, circulated on the network. Marina Ovsyannikova was in the frame wearing a necklace in the colors of the flags of Russia and Ukraine and explained that her mother is Russian and her father is Ukrainian. She asked the audience for forgiveness for her work on the “First”, condemned the actions of the Russian army on the territory of Ukraine and expressed the hope “that the fraternal peoples will still be able to reconcile.” Separately, she called on the Russians “to be afraid of nothing” and “to go to rallies.”
By the time the video was published, Marina Ovsyannikova had already been detained by the police, after which she disappeared for 15 hours: lawyers searched for her all night in various police stations, the human rights project OVD-info (included in the register of foreign agents) even turned to the working group on violent or involuntary UN disappearances. Only on the evening of March 15, lawyer Sergei Badamshin reported that Marina Ovsyannikova was in the Ostankinsky District Court of Moscow. On the same day, she was fined 30,000 rubles, but not for the rally on Pervy, but for the video that followed the rally with calls for rallies – under the article on “organizing or holding a public event without filing a notification” (part 2 of Art. 20.2 of the Code of Administrative Offenses).
Later, Marina Ovsyannikova was fined two more times – already for “discrediting” the Russian army (Article 20.3.3 of the Code of Administrative Offenses) – 40 thousand and 50 thousand rubles each, respectively. The courts held her accountable for her speech at the Basmanny Court on the day of the trial of politician Ilya Yashin (recognized as a foreign agent, is also in jail in the case of “dissemination of false information about the RF Armed Forces”) and for a post on Facebook (owned by Meta, recognized in RF extremist) criticizing the military operation in Ukraine.
In the intervals between Russian actions and fines, Marina Ovsyannikova managed to go abroad and return, as well as work in the German edition of Die Welt. In an interview with the media, she explained that she returned to the Russian Federation for the sake of her children (she has a minor son and daughter), and admitted that she “ruined her life” with her act – but does not regret it.
