The court came to the defense of the famous actress Leah Akhedzhakova in her fight against fake accounts. He recognized as illegal the refusal to initiate proceedings on an administrative offense, which, by the way, was issued a year (!) After the appeal of the People’s Artist of the Russian Federation.
Back in early May 2022, Liya Akhedzhakova applied to Roskomnadzor with a complaint against unknown persons who, on her behalf, created three fake pages on social networks. They published texts to which the actress had nothing to do.
Roskomnadzor’s office for the Central Federal District initially refused to help even block these fakes. Instead, it invited Akhedzhakova to contact the social media administrators herself. Only after filing a lawsuit with the department, it still required the platforms to eliminate the violation, which they did. But the actress and her lawyer asked to find those responsible.
A year after the appeal to Roskomnadzor, a decision was made to refuse to initiate an administrative offense case (dated April 26, 2023, and it was delivered even later – May 12). At the same time, Roskomnadzor referred to the absence of an event of an offense.
– This argument, undoubtedly, is refuted by the presented evidence, legal science, common sense, – says lawyer Alexander Maev.
From the printouts of pages on the social network, it follows that they should have been perceived by an unlimited circle of users as pages of her own authorship. The pages were viewed by tens of thousands of people, dozens of media outlets reprinted the content (text content), which caused significant reputational and moral damage to Akhedzhakova. Consequently, there are actions of unknown persons, in relation to which we can say that they contain an administrative offense under Part 1 of Art. 13.11 of the Code of Administrative Offenses of the Russian Federation “Violation of the legislation of the Russian Federation in the field of personal data.”
The Simonovsky Court of Moscow agreed with this. This decision is a victory for all the famous people who fight the fake page creators on their behalf.
