Lawyer of Yuri Shevchuk appealed against the decision to impose a fine

The lawyer of the leader of the DDT group Yuri Shevchuk, Alexander Peredruk, told Kommersant that today, August 25, he filed an appeal with the Supreme Court of Bashkiria against the decision of the Sovetsky District Court of Ufa, which on August 16 found the musician guilty of discrediting the army (part 1 of article 20.33 of the Code of Administrative Offenses RF) and fined 50 thousand rubles. Solution was rendered on the basis of a protocol drawn up after a concert in Ufa on May 18, at which Yuri Shevchuk spoke out against the military conflict in Ukraine.
The complaint states that the decision is illegal and unfounded, issued in violation of the constitutional rights of Yuriy Shevchuk, and therefore is subject to cancellation with the termination of the proceedings on the case of an administrative offense.
In particular, Alexander Peredruk pointed out that the Sovetsky District Court did not have the appropriate competence to consider the case, since it had previously granted the musician’s request to transfer the case to St. Petersburg, at the place of residence of the accused. The case materials do not indicate that Yuriy Shevchuk was properly notified of the date, time and place of the protocol, the complaint notes. Also, the court did not take into account that in the protocol on an administrative offense the controversial phrases of the DDT leader were taken out of context. In addition, the court did not give a proper assessment of the personality of Mr. Shevchuk and the fact that he had not previously been brought to administrative responsibility, the lawyer concluded.
