This morning, a counter-terrorist operation regime was introduced in Moscow, the Moscow and Voronezh regions. The CTO regime is regulated by the federal law Federal Law “On Counteracting Terrorism”. It is introduced “in order to prevent and disclose a terrorist act, minimize its consequences and protect the vital interests of the individual, society and the state.” It is announced by the “head of the federal executive body in the field of security”, that is, the head of the FSB or any employee of the service at his direction.

In the course of the CTO regime, a “strengthening of protection” of transport, objects of vital activity, cultural values ​​and public order in general is introduced.

But most importantly, the state suspends many civil rights.

First of all, the police and other power structures can check the documents of any passer-by. If there are no documents, a person can be taken to the police department or to “other competent authorities” for identification. They can also inspect people, their cars and things that are with them.

It is also possible to “remove” citizens and tow vehicles from “separate sections of the terrain and objects”. Representatives of the authorities can “temporarily resettle” people from dangerous territories, but “with the obligatory provision of such persons with stationary or temporary living quarters.”

Law enforcement officers receive the right to “unimpeded entry” into any buildings and premises, but only “to carry out measures to combat terrorism.” The secrecy of correspondence is temporarily abolished: the state can control telephone conversations, telecommunications networks and other means of communication. In general, communication services may be suspended or limited in general.

The security forces can use the vehicles of any organization, whether public or private (but not foreign). And “in urgent cases” – to requisition transport from private individuals. The good news is that then the state compensates for possible costs.

Also, the state can suspend hazardous production – and in general, activities in which “explosive, radioactive, chemically and biologically hazardous substances are used.” If necessary, they can introduce quarantine and carry out sanitary and anti-epidemic measures.

Finally, it is possible to “restrict or prohibit the sale of weapons, ammunition, explosives, special means and poisonous substances” and “establish a special regime for the circulation of medicines and preparations containing narcotic drugs, psychotropic or potent substances, ethyl alcohol, alcoholic and alcohol-containing products.”

It is important to remember that on the territory of the CTO regime, both all these restrictions and only some of them can be introduced. There are no fixed deadlines and no CTO regime – it is valid until the order to cancel.

The second document worth studying is Art. 20.27 of the Code of Administrative Offenses of the Russian Federation “Violation of the legal regime of the counter-terrorist operation.” Here is what it says:

  • for disobedience to the lawful demand of an FSB officer, a fine is imposed. Citizens – up to 500 rubles, officials – from 1 thousand to 3 thousand, legal entities – from 5 thousand to 10 thousand rubles;
  • unauthorized entry into the territory of the KTO or an attempt to do so – a fine of 500 to 1 thousand rubles;
  • impeding the conduct of a counter-terrorist operation is punishable by a fine of up to 2,000 rubles. or administrative arrest up to 15 days. Officials – up to 5 thousand rubles. or up to 30 days of arrest, for legal entities – from 10 thousand to 30 thousand rubles;
  • The media can be fined for “conditions of coverage of the counter-terrorist operation.” Citizens – from 500 to 2 thousand rubles, officials – from 1 thousand to 5 thousand, legal entities – from 30 thousand to 100 thousand rubles.
