“Kommersant”: a contract soldier received 10 years for the murder of the National Guard in the NVO zone

The Crimean garrison court sentenced Aleksey Usenko, a member of the special operation, to 10 years in prison for killing a member of the National Guard in the conflict zone. The Southern District Military Court in Rostov-on-Don rejected all arguments of the defense and the verdict entered into force.
How informs Kommersant, the incident happened last year. As the investigation found out, Usenko, who was part of a military convoy, stopped a car in which there were two employees of the National Guard. They went out onto the road, the driver of the car introduced himself and took out documents, while Usenko shot at the second military man, and ordered the driver to lie down on the ground.
Other servicemen who came running to the shots persuaded Ustenko to hand over their weapons. They also testified that he smelled of fumes. Ustenko himself behaved aggressively and claimed that he had detained Ukrainian saboteurs.
On this fact, the military investigation department of the ICR opened a case under the articles “Deliberate murder” and “Threat to kill.”
During interrogation, Ustenko stated that it was not he who fired, but saboteurs under the cover of darkness. The defense drew attention to the fact that there were no traces of gunpowder on the hands of the defendant, and the cartridge case, taken from the pocket of his pea coat, had a whole gunpowder igniter primer. A polygraph test also showed that Ustenko was not involved. But the court decided that these arguments were refuted by a combination of other evidence – washing off the hands was done only after 12 hours, traces of gunpowder were found on the jacket, and the polygraph test was carried out with violations.
The defense will apply to the Military Court of Cassation.
