Kazakhstan reported that the Rome Statute of the ICC does not apply to the republic

The Rome Statute of the International Criminal Court (ICC) does not apply to Kazakhstan, since the republic did not sign it. This was announced by the official representative of the Ministry of Foreign Affairs of Kazakhstan Aibek Smadiyarov.
“We have not signed or ratified the Rome Statute. The statute does not apply to Kazakhstan, and we have no obligations under it,” he said (cit. according to TASS).
On March 24, the Constitutional Court of Armenia ruled that the obligations set out in the Rome Statute of the ICC are in line with the country’s fundamental law. The Russian Foreign Ministry considered “absolutely unacceptable” Yerevan’s plans to join the Rome Statute against the backdrop of the issuance of an arrest warrant by the ICC on March 17 for Russian President Vladimir Putin and the children’s rights commissioner in the Russian Federation Maria Lvova-Belova. As Die Zeit wrote, this decision obliges the member states of the court to arrest the wanted persons and transfer them to The Hague.
The Rome Statute is the founding document of the ICC; as of March 2023, 123 states have ratified it. Among the states friendly to Russia, these are, for example, the BRICS countries Brazil and South Africa (there will host an association summit in 2023), Tajikistan and Moldova.
Russia is not among the participants in the ICC, although Moscow signed the statute back in 2000. In November 2016, Putin signed a decree on Russia’s intention not to become a full member of this body. The Foreign Ministry then explained that the Hague court “did not justify the hopes placed on it and did not become truly independent.”
